VOTE FOR THE INDEPENDENT SPECIALTY FOOD STORES THAT YOU’D LIKE TO SEE FEAUTURED ON MERCATO.COM. OUR DIGITAL MARKETPLACE ENABLE FOOD LOVING CONSUMERS TO PURCHASE CRAFTED FINE FOODS ANYTIME, ANYWHERE, DELIVERED TO THEM.

YOU’LL BE ENTERED INTO THE “MERCATO GOURMET GIVEAWAY” SWEEPSTAKES AND HAVE A CHANCE TO WIN ONE MONTH’S WORTH OF CRAFTED FINE FOODS DELIVERED TO YOUR DOOR ($100 VALUE).

OPEN ONLY TO LEGAL RESIDENTS IN UNITED STATES, WHO ARE AT LEAST 18 YEARS OLD, AS OF THE DATE OF ENTRY AND CURRENTLY MEET ALL ELIGIBLITY REQUIREMENTS. In order to redeem prize, the winner must reside within the delivery zone of a specialty store featured on Mercato.com that falls within the applicable zip code.  

SPONSOR and ADMINISTRATOR: The Sponsor of the promotion is Mercato.com ("Sponsor"). The administrator of the promotion is Mercato.com ("Administrator"). Administrator will conduct the promotion as described in these Official Rules. By participating in the promotion each entrant agrees as follows:

ENTRY PERIOD: The promotion begins at 9:00 AM PST on the 1st day of every month and ends at 11:59 PM PST on the last day of the month.

HOW TO ENTER: No purchase necessary. Participants must submit their email address and zip codes and vote for an independent specialty food store that you’d like to see featured on Mercato.com. Submit vote by selecting a specialty store from the drop down or by submitting your own store. Participants may fill out one entry form per email address for the entire duration of this promotion.

If you enter the promotion under false contact information, as determined by the Administrator, you will be disqualified and ineligible to win the prize.

Sponsor reserves the right to disqualify any person tampering with the operation or conduct of the promotion. Sponsor reserves the right to cancel, or modify the promotion if it cannot be conducted or completed as planned, for any reason. If the promotion is cancelled, modified, or suspended, notice will be posted.

Promotion sponsor, affiliates and employees and any entity involved in the production, administration, judging or fulfillment of the promotion including, without limitation, the immediate family members and/or those persons living in the same household of such individuals, are not eligible to participate. By entering the promotion, entrants agree to comply with these rules and the decisions of the judges which are final and binding in all respects. Failure to comply with these rules may result in disqualification from the promotion.

PRIZE DESCRIPTION: One month of FREE gourmet food ($100 value). $100 will be provided in the form of a Mercato digital account credit or promotional code, to be redeemed on mercato.com by purchasing from any merchant on the Mercato marketplace that falls within your delivery zip code. Winner must reside within the specialty store’s delivery zone.   

ODDS OF WINNING: The odds of winning this Promotion will vary and depend on the number of eligible entries received.

SELECTION OF WINNERS: Winner will be announced by the 7^th of the following month. The winner will be randomly selected from all eligible participants. The winner will be selected by Administrator, whose decisions and interpretations on all matters relating to the promotion and these Official Rules are final and binding in all respects. Administrator reserves the right to disqualify any participant or winner. Odds of winning a prize depend on the number of eligible entries received. If promotion is extended beyond the initial dates, each winner can only be chosen once throughout the duration of the promotion.

PRIZE REDEMPTION: Qualifying, unofficial winners will be notified by email. Winner must meet all eligibility requirements before being announced as the official winner. Return of a prize or prize notification as undeliverable, or inability of Administrator to contact and hear back from a potential winner within forty-eight (48) hours of selection, may result in disqualification of such potential winner, and an alternate winner may be selected by random drawing at Administrator's discretion. In the event a winner declines a prize, Administrator may, at its discretion, select an alternate winner by random drawing. Prize must be redeemed within 90 days of winner announcement, otherwise it will expire.

PUBLICITY, PRIVACY & PRIZE NOTIFICATION: By completing and submitting a form, entrant grants the Administrator worldwide, royalty-free permission to use their name on the Mercato.com website. Additionally, by entering the giveaway entrants are automatically subscribed to Mercato.com promotional emails. Entrants can unsubscribe from the promotional emails at anytime. Entrants waive any and all claims and/or rights to receive any royalties or other compensation for the Administrator's use thereof, unless prohibited by law.

GENERAL: The promotion is void where prohibited by law and is governed by the laws of the United States of America. The submission of an entry is the responsibility of the entrant. Only eligible entries received within Entry Period will be included in the prize drawing. For purposes of these Official Rules, "receipt" of an online entry occurs when Administrator receives a submitted form. Promotion Sponsor is not responsible for late, lost, delayed, unclear, incomplete, misdirected or ineligible entries, which will be disqualified, or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, or delayed electronic communications caused by the sender which may limit the ability to participate, or by any human error that may occur in the processing of the entries in the promotion. Any person attempting to defraud Administrator or Sponsor or in any way tamper with, damage or undermine the operation of the promotion will be disqualified and may be subject to civil and/or criminal prosecution.

LIMITATION OF LIABILITY: Entrants agree to hold harmless the promotion Sponsor and Administrator is not responsible for all injuries, losses, damages, claims, and actions of any kind arising from or relating to participation in the promotion, or acceptance, possession, use, misuse, or nonuse of the prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages.

DISCLAIMERS: (a) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsor's servers or elsewhere, will not be eligible. In the event of a dispute, entries will be deemed submitted by the Authorized Account Holder of the email address submitted at the time of entry. "Authorized Account Holder" is defined as (depending of method of entry) either the natural person who is assigned to an email address by an Internet Access Provider, or an online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning email addresses for the domain associated with the submitted email address. (b) Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the website. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Sponsor. (c) Sponsor further reserves the right to cancel, terminate or modify the Promotion if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. (d) Sponsor Entities are not responsible for errors in the administration or fulfillment of this Promotion, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Promotion based upon such error at its sole discretion without liability. (e) SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS PROMOTION OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
